​The U.S. District Court in Utah has agreed to weigh broadcasters’ motion for an injunction to stop local TV streaming service Aereo.

A federal judge in Salt Lake City will hear arguments in favor of the injunction on Tuesday. If the broadcasters prevail, the court’s decision would apply in the six states that make up the U.S. Court of Appeals for the Tenth Circuit.

The hearing in Utah comes even as the U.S. Supreme Court is preparing to rule on the streaming service’s legality. A decision from the High Court is expected in June.

The broadcasters argued in papers filed last month with U.S. District Court Dee Benson that Aereo’s continued presence in Utah while the Supreme Court heard the case against the company would threaten their “goodwill with viewers” and “create confusion.”

Aereo rents out a small antenna to users which transmits broadcast television to multiple devices such as smartphones. The broadcasters say the IAC-backed startup is illegally retransmitting television; Aereo says it is simply renting remote antennas.

Brief Take: Similar motions in other jurisdictions have failed in the past, but Tuesday’s hearing adds more drama to what’s turning out to be THE court fight of 2014. If Aereo wins, some broadcasters have threatened to go to a cable-only service.
