After a lawsuit, an appeal and a final appeal this week, broadcasters are coming up empty in the case against Aereo. The US Court of Appeals has ruled in Aereo’s favor based on the Cablevision decision, in which it wanted to create a DVR service but copyright holders cried infringement.
Against broadcasters’ wishes, Aereo will not have to pay retransmission fees for the local station TV signals it broadcasts over the Internet. Broadcasters have now lost twice in court, but they still have the option of appealing to the Supreme Court, which they are expected to do.
