Faced with a looming Supreme Court battle and a recent legal setback in Utah, online TV streamer Aereo is soldiering on, announcing an expansion Monday into Austin.

Austin is Aereo’s fourth market in Texas following San Antonio, Houston, and Dallas-Fort Worth. And Monday’s announcement comes a little less than a week after a U.S. District Court judge in Salt Lake City blocked the streaming service from operating there while the Supreme Court decides whether the service is legal.

Each of the Big Four networks have sued to put a stop to Aereo, which rents out a small antenna to users that transmits broadcast television to multiple devices such as smartphones.

Ther broadcasters say the IAC-backed startup is illegally retransmitting television; Aereo says it is simply renting remote antennas.

Both sides are set to square off at the High Court on April 22. A decision is expected in June.

Austin would have been Aereo’s 13th city, but the Utah decision means that Denver and Salt Lake City residents can no longer sign up for the service. Aereo has already halted signups in New York City and Atlanta due to “high demand.”

The service is also available in Boston, Miami, Detroit, Baltimore and Cincinnati.
